For the proper balance of employers’ responsibilities and Employee rights, regulatory laws are very active in the United Arab Emirates because of which the workforce and progress are rapidly increasing. These laws provide rights and opportunities to employers to succeed in their business and economy as long as they fairly and equally treat all the employees according to the laws.
In UAE you cannot make your employees work for you out of proper durations and if you make them work for you for over 8 hours on normal days and 6 hours in Ramadan then you should pay a 25% supplement to the worker. If you make them work between 9 pm to 4 am then the employer must pay a supplement of 50% to the employee for this specified period of time.
Workers must get one hour break after a 5hours shift and a week’s rest day is mandatory for an employee working in UAE. This rest day is usually given on Friday. Workers must also get a yearly leave of at least one month or thirty calendar days. During the period of the Hajj pilgrimage and employees can take leave for one month and this is supposed to be unpaid.
Women employees can take leave of 45 days as maternity leave if they are pregnant. The employer must pay her full salary or half salary if the Woman has got less than one year of experience in the company. The employer cannot suspend a women employee when she is pregnant. Female workers must be paid the same amount as men workers without any discrimination.
The employer must provide the workers with the security of health, wealth, and life. If the workers are involved in any kind of moral, physical, or ethical misconduct the employer can dismiss them with or without notification. If the workers are removed from work without any proper reason they can contact UAE authorities and they can claim their compensation from the respective organization or employer.
All the organizations and employers must sign a written document comprising the contract with all the rules, regulations, and responsibilities for the workers. This contract is to be signed with the ministry of Human resources of UAE. The maximum duration of this written contract is usually 2 years. In simple words, this contract is an agreement between the worker and the employer in which every minute detail related to working hours, salary, and resources along with off days are finalized so that any kind of discrimination is avoided both for the workers and the owner of the organization or employer.
